Realtimate Privacy Policy
This Privacy Policy explains how we at Realtimate Labs Private Limited (collectively, “Realtimate”, “Company”, “we”, “us” or “our”) collect, use, share and process your information, that you provide to us through your use of the Application [Realtimate] and Website [PropHunt AI] (collectively referred to as “Platform”) in the course of providing services (“Services”) as defined in the Terms of Use [Master Terms] to you.
Please use our Services only if you agree to the use of your information in accordance with the terms set out below in the Privacy Policy of the Company.
By clicking “I accept” when downloading the Application or proceeding to the Website and/or using our Services you represent that you voluntarily provide us with Personal Information (hereinafter defined) and consent to its collection, use, disclosure and transfer in accordance with this Privacy Policy. You also represent that you are duly authorised by any third party whose information you share with us. We shall act as per your representation of authority and shall not make any independent enquiries to ascertain the veracity of your authorisation. In the event you do not have sufficient authorisation you shall be solely responsible for your acts and omissions including sharing of information with us by you and the consequential processing and actions taken by us in accordance with this Policy.
1. Types of Personal Information We Collect
When you sign up or register on our Application or Website to use our Services, and during the course of usage of our Services, the types of information that will be collected by us include:
- Contact information such as name, images, contact / postal address, telephone and email id.
- Financial information such as bank account or other payment instrument details.
- Any other personal identification proof such as permanent account number, driving license or passport.
- Any information provided by you towards complying with know your customer norms, either as part of our internal policies and as may be required under applicable law.
- Transactional information such as order details, transactional history (other than banking details) about your activities on our Platform.
- Your internet protocol address.
- Identification code of the communication device (Device ID) that you use to access the Platform or otherwise deal with Realtimate.
The information specified above shall be collectively referred to as “Personal Information”.
2. Sources of Data Collection
We collect your information that you provide directly to us through your use of the Platform including when you register for an account, request an offer, upload or otherwise submit photos, make an offer, provide your feedback about the Platform or contact us with queries or comments.
We also collect information that you voluntarily choose to provide to us through Platform, email, during interaction with us on call or chat, and other modes of communication.
3. How We Use Your Personal Information
We reserve the right to collect, use, store and process your Personal Information for any purpose that may be permissible based on the consent obtained from you and under applicable laws in connection with your transaction with or on the Platform and/or for functions or activities of Realtimate. Such purposes (“Purposes”) include but are not limited to:
- Facilitating your transactions on, and your use of the Platform.
- Provision of services by Realtimate.
- Responding to your inquiries or fulfilling your requests for information about the services offered on the Platform.
- Providing you with information about services available on the Platform and sending you information, materials, and offers from Realtimate.
- Sending you important information regarding the Platform, changes in Terms of Use, policies and/or other administrative information.
- Properly administering the Platform.
- Conducting internal reviews and data analysis for the Platform.
- Improving the services, content and advertising on the Platform.
- Facilitating various programmes and initiatives launched by Realtimate itself or through a collaboration with third party service providers or banks and partners.
- Responding to legal, judicial, quasi-judicial process and providing information on law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law.
- Conducting analytical studies on various aspects including user behaviour, user preferences.
- Implementing information security practices.
- Determining any security breaches, computer contaminant or computer virus.
- Investigating, preventing, or taking action regarding illegal activities and suspected fraud.
- Undertaking forensics of the concerned computer resource as a part of investigation or internal audit.
- Tracing computer resources or any person who may have contravened, or is suspected of having or being likely to contravene, any provision of law including the Information Technology Act, 2000 that is likely to have an adverse impact on the services provided on any Platform or by Realtimate.
- Sharing or transfer of such data in the event of any merger, acquisition, reorganization or sale of assets or business of Realtimate to a third party or in the event of bankruptcy of Realtimate.
You hereby agree and acknowledge that the Information so collected is for a lawful purpose, connected with a function or activity of Realtimate, and the collection of Personal Information is necessary for the Purposes.
4. Disclosure and Transfer of Personal Information
You hereby agree and permit that Realtimate may transfer, share, disclose or part with all or any of your Personal Information, within and outside India to service providers / partners / agencies / authorities / banks and financial institutions for one or more of the Purposes, to government agencies upon directions of such agency, or to any other third party as may be required under applicable law. In case of any Personal Information so transferred, shared, disclosed or parted with, we will contractually oblige the receiving party(ies) of the Personal Information to ensure the same level of data protection adopted by Realtimate is adhered to by the receiving party(ies), subject to applicable law.
Realtimate may also share information with law enforcement agencies pursuant to lawful requests for information, and otherwise as required under any law applicable at the given time, both in India and outside India.
5. Your Rights
We take reasonable steps to ensure that your Personal Information is accurate, complete, and up to date. However, you have the sole responsibility of ensuring that you review the accuracy of information provided by you and contact us in case of discrepancies, or in case you wish to discontinue the use of our services. You have the right to access your Personal Information, and request correction and deletion. If your Personal Information changes, you may correct, delete inaccuracies, or amend information by making the change on our Platform or by contacting us in the manner specified in section 10 of this Privacy Policy.
The consent that you provide for the collection, use and disclosure of your Personal Information will remain valid until such time it is withdrawn by you in writing. If you withdraw your consent, the Company will stop processing the relevant Personal Information except to the extent that the Company has other grounds for processing such Personal Information under applicable laws.
You may contact us in the manner specified in section 10 of this Privacy Policy to exercise your rights. We will respond to your request in a reasonable timeframe, and in any event in less than 30 days.
6. Data Retention Policy
We store your Personal Information in accordance with applicable laws, which means we keep your data for as long as necessary to provide you with our Services or as may be required under any law. We shall store your Personal Information for lawful purposes only.
If you close your account, we have no obligation to retain your data, and we may delete any or all of your data without liability. However, we may retain data related to you if we believe it may be necessary to prevent fraud or future abuse, or if required by law, or for other legitimate purposes. We may continue to store your data in anonymised form for analytical and research purposes.
7. Information Security Policy
We use reasonable technical, administrative, and physical security measures for the purpose of safeguarding all data you share with us. We also have comprehensive internal policies in place to prevent unauthorized access to your data. We take adequate steps to ensure that third parties we share data with also adopt reasonable level of security practices and procedures to ensure the privacy and security of your information.
However, we are not responsible for any loss, unauthorised access, safety issue or any harm caused to you by any misuse of your Personal Information, unless it is a direct and foreseeable consequence of negligence and non-compliance on our part only.
For any data loss or theft due to unauthorized access to your electronic devices through which you avail our Services, Company shall not be held liable for any loss whatsoever incurred by you. Further, you are liable to indemnify the Company as per the Terms of Use.
8. Third Party Websites and Services
Our Platform may contain links to third party services, and give you the ability to access such third-party websites, products, and services. Please note that you may proceed to the use of such third party website or service at your own risk and Realtimate will not be held liable for any outcome or harm arising as a result of your use of such third party websites or services. Please read the privacy policies of any third party before proceeding to use their websites, products, or services.
9. Changes to this Privacy Policy
We may periodically revise or update this Privacy Policy. Your continued use of our Services after the effective date of the Privacy Policy means that you accept the revised Privacy Policy. If you do not agree with any such revised terms, please refrain from using our Services and contact us to close any account you may have created.
In the event there are significant changes in the way Realtimate treats your Personal Information, the revised Privacy Policy will be displayed on the Platform and we may inform you of the same over email. If you object or disagree with any of the changes or you no longer wish to use the Services, you may contact us in the manner specified in section 10 of this Privacy Policy to deactivate your account.
